Lawsuit against Oakland’s coal ban can proceed, judge rules

A federal judge on Thursday rejected Oakland’s request to dismiss a lawsuit filed by prominent developer Phil Tagami over a citywide ban on transporting or shipping coal... Margaret Rossoff of the group No Coal in Oakland, said the judge appeared to be willing to let the Sierra Club and San Francisco Baykeeper intervene in the lawsuit to defend their positions on the environmental impacts of the project.

“We don’t want the city to cave, we would like them to come up with an alternative use for the property, a marine terminal that has healthy products and negotiate to make that appealing to Tagami,” Rossoff said. “That would be a happy ending for all concerned.”
